PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
1. General
These terms and conditions (“Terms of Service”) apply to the purchase and sale of products and services through Larratt Bros. Plumbing, Inc. By placing an order for such products and services, you are agreeing to these Terms of Service in whole. You acknowledge that you have read, understand, and will be bound by these Terms of Service. You further acknowledge that this Terms of Service, along with any applicable proposal which you have received from Larratt Bros. Plumbing, Inc., represent the complete and exclusive statement of the agreement between us and that it supersedes any prior proposal or agreement, oral or written, and any other communications between us relating to the subject matter of this agreement.
2. General Exclusions from the Hourly Rates Quoted
Except as indicated in writing, the following work is not included in the services provided by us, and will be subject to additional charges:
Existing pipe conditions
Shutdown and startup of all equipment
The following work will not be performed by Larratt Bros. Plumbing, Inc.:
Wall/ceilings (opening, closing, patching, and painting)
New beam penetration, general engineering, and gusseting
All electrical work
Temporary utilities, sanitary facilities, and HVAC duct and/or piping
Hazardous materials work of any kind
Demolition or removal of fixtures and appliances
Changes or damage to landscaping required to complete work
3. Work authorized by HOA:
When work is requested by a Homeowner’s Association (“HOA”), the following information is to be provided by the HOA prior to the commencement of work:

By signing the invoice at the completion of work, the owner/tenant is solely acknowledging services requested by homeowners association have been completed. The HOA is responsible for payment to Larratt Bros. Plumbing.
4. Hours, Payments/Billing
Drive time of 0.5 hours will be added to hours worked during Office Hours (defined below). Overtime and Double Time calls will billed “portal to portal” and defined as time of dispatch to completion of work.

Office Hours: 7am – 4pm, Monday-Friday, excluding Federal holidays
Overtime and Double Time Rates Apply outside Office Hours as described below - Rates in San Mateo County
Straight Time Rate, $180/Hour (Office Hours)
Overtime Rate, $270/Hour (6am – 7am, 4pm – 7pm Monday – Friday, and first 10 hours on Saturday, excluding holidays)
Double Time Rate, $360/Hour (7pm – 6am Monday – Saturday in excess of 10 Hours, Sunday 24 hours, and all holidays) - Rates in San Francisco County
Straight Time Rate, $200/Hour (Office Hours)
Overtime Rate, $300/Hour (6am – 7am, 4pm – 7pm Monday – Friday, and first 10 hours on Saturday, excluding holidays)
Double Time Rate, $400/Hour (7pm – 6am Monday – Saturday in excess of 10 Hours, Sunday 24 hours, and all holidays) - Payments and Billing Payment is required when services have been rendered. Payment may be made by major credit card or personal check. A $50.00 returned check fee may be assessed for any dishonored checks. In the event of a default in payment, we may recover all of the contract price which may be then due, together with interest which shall accrue at the rate of 1.5% per month or the legally maximum rate of interest, whichever is less. In addition, reasonable attorney fees and costs of collection shall be added to the balance due and shall be included in any award or judgment for non-payment.
Non-payment may result in a mechanics lien against your property for the amount of services including any reasonable attorney fees and costs of collection.
5. Warranty on Products Provided by Larratt Bros. Plumbing, Inc.
Service and New Construction: Parts installed and provided by Larratt Brothers, Plumbing, Inc. l are warranted to be free from defect, and all work is warranted as completed in a workmanlike manner, for a period of 1 year from date of installation. Existing components in relation to the newly install parts are excluded from any warranty.
6. Customer Supplied Materials
If a customer supplies materials to be installed by Larratt Brothers Plumbing, Inc. the quality and/or integrity of those materials is your responsibility. If there is any problem with the customer-supplied materials, it is your responsibility to contact the manufacturer of the materials for warranty repairs. Any follow up service calls to replace/repair customer-supplied materials are chargeable to the customer by Larratt Brothers Plumbing, Inc. If materials are determined to be damaged or defective during installation by Larratt Brothers Plumbing, Inc.’s service technician, it is your responsibility to replace the defective or damaged material. Larratt Brothers Plumbing, Inc. is not liable for any incident or injury due to the operation of customer-supplied materials.
7. DISCLAIMER AND LIMITATION OF LIABILITY. OUR RESPONSIBILITY FOR ANY DEFECT RELATING TO THE PRODUCTS AND SERVICES PROVIDED BY US, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS OR SERVICES WE PROVIDE. In no event shall Larratt Brothers Plumbing, Inc. be liable to you or any other person for any special, indirect, incidental, or consequential losses or damages. THE WARRANTIES SET FORTH IN THIS TERMS OF SERVICES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WHICH ARE HEREBY DISCLAIMED AND EXCLUDED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
